Earth’s Healing alleges that Shenzhen Smoore Technology Co. Ltd. and its authorized distributors—horizontal wholesale competitors—entered a per se unlawful agreement not to compete, violating Section 1 of the Sherman Act and inflating CCELL vape prices, harming plaintiff and other U.S. direct purchasers. Since 2016, Smoore, a dominant Chinese CCELL manufacturer, allegedly fixed minimum resale prices and barred distributors from soliciting one another, enforcing compliance via contracts, training, meetings, monthly customer/pricing reports and penalties (including deductions from security deposits).
