In late May 2022, Lieff Cabraser and Edwards & Jennings filed a proposed Second Amended Class Action on behalf of Benton Harbor residents, alleging that since at least 2018 the city’s water was contaminated by lead, bacteria, and other toxins above state and federal Safe Drinking Water Act limits, exposing many residents—including children—in a predominantly African‑American community. The complaint seeks compensatory and punitive damages, a declaration that defendants’ conduct was unconstitutional, and equitable and injunctive relief including repairs and property compensation; immediate abatement/replacement of lead service lines and delivery of clean water until replaced; medical monitoring and testing; appointment of a water operations Monitor and establishment of a Community Medical Center; forgiveness of pipe‑replacement loans; an injunction preventing residents from paying for contaminated water; and disgorgement of prior payments.
