Two consolidated class actions—Larry Tran (No. 22STCV26572) and Robert Cohen (No. 23STCV08339)—are before the Los Angeles County Superior Court against Sprouts Farmers Market, Inc. and SFM, LLC. Plaintiffs contend Sprouts violated FACTA (15 U.S.C. §1681c(g)) by printing more than the final five digits of payment card numbers, including EBT cards. Sprouts denies liability, secured dismissal of the operative complaints, and the plaintiffs appealed. To avoid further litigation costs and uncertainty, the parties negotiated a proposed class settlement; the Court of Appeal remanded the matters for settlement approval. Sprouts does not admit any FACTA violation by entering the settlement.
