Hagens Berman has filed a nationwide class action against ByteDance, alleging CapCut unlawfully harvests and distributes highly sensitive user information—including unique identifiers, biometric data, images, audio, clipboard contents, geolocation, names, emails, passcodes, social accounts, messaging and phone numbers—and makes it accessible to the Chinese government. CapCut, used to edit videos for platforms like TikTok, exceeded 400 million downloads in 2022. The complaint asserts ByteDance monetizes this data through targeted advertising, AI development, patenting and cross‑product marketing that enables precise demographic tracking. Congress is considering a nationwide ban unless the app is divested.
