Hagens Berman sued CSAA General Insurance on behalf of Arizona motorists, contending that uninsured/underinsured motorist (UIM) limits should be applied per insured vehicle rather than as a single payout. In April 2022 the firm filed suit after a woman who received $50,000 under her UIM policy sought an additional $50,000 tied to her deceased mother’s separate vehicle and CSAA denied “stacking.” The Arizona Supreme Court held that UIM benefits may be recovered on a per-vehicle basis, permitting the extra $50,000. Drivers who already received a full UIM payout may still be able to pursue additional recovery.
