About this case
Nov. 2017: Hausfeld, representing Suffolk County Water Authority (serving ~1.2M Long Island residents), sued five leading manufacturers, distributors, retailers and promoters of 1,4‑dioxane and products containing it. The Authority alleges the defendants knowingly produced, promoted, or sold toxic 1,4‑dioxane products that reached and contaminated groundwater, polluted drinking wells, and threatened public health, and seeks remediation costs. A 2018 dismissal motion was denied except as to one claim. After extensive depositions, fact and expert discovery closed in 2023; Daubert and summary‑judgment briefs were fully filed as of May 2024. The case, Suffolk County Water Authority v. The Dow Chemical Company et al., No. 2:17‑cv‑06980 (E.D.N.Y.), is assigned to Judge Nina Gershon and Magistrate Judge Roanne Mann, was prioritized for trial, and prompted 26 similar public‑water suits now pending in the Eastern District of New York.
