About this case
Inspire Medical manufactures Inspire V, an implantable device for obstructive sleep apnea. A class action alleges the company made false or misleading statements and omitted that the Inspire V launch failed: demand was weak because providers held excess inventory and were reluctant to switch, and essential pre-launch tasks were not completed. On August 4, 2025, Inspire disclosed an “elongated timeframe,” noting many centers hadn’t finished training, contracting, or onboarding; billing software updates didn’t take effect until July 1 despite CPT approval; and excess inventory harmed demand. The company cut 2025 guidance by over 80% and its stock fell more than 32%.
