We represent former students in a class action against The Hotchkiss School alleging they were groomed, inappropriately touched, assaulted, and raped by Roy Smith, an English teacher and athletic trainer the School knew to be a pedophile who abused multiple male students. Class representative “Mark Moe” (pseudonym) seeks classwide certification of Hotchkiss’s duty and breach to avoid relitigation and facilitate accountability. Lieff Cabraser secured prior rulings by Judge Victor Bolden (D. Conn.) allowing similar Hotchkiss claims to proceed (Mar. 8, 2019; Jul. 8, 2019); those matters and a third pre-litigation case later resolved.
